Just saw a post on reddit alternatives and there was a comment inviting users to laguna.chat. I went and checked it out and the trending communities list included, ‘jews did 911’, ‘killnirs’, ‘hitler was right’, and 'Fuck Nirs’. One of the user accounts was u/HangNi***rs.

    Looks like an instance someone spun up and never looked at again.

    It clearly has no one policing content, or I’d hope someone would have flagged the shit porn on their support communities.

    Just because anyone can start an instance doesn’t mean everyone should.

      It feels like s legal liability to start a instance and not police it. People could upload CP and you would be on the hook because you are the server owner and clearly did nothing to stop it.

        It’s worse because now other servers federating with you are on hook legally as well.

        The law doesn’t make allowances for federated servers. Essential it’s your sever getting the CP in the eyes of the law.

          The short, definitely not legal advice version is that it only becomes a crime if you have actual knowledge that there is CP on your server, and you fail to block access to it and make the legally mandated report.

          The law was written with ISPs hosting email and websites for paying customers in mind, but it applies equally well to anonymous user-generated content, federation, and other scenarios we may not have even imagined yet. Being an inattentive server admin is a valid legal defense, though actually having to use it in court would be stressful and expensive.

          That can’t be accurate otherwise it’d be incredibly easy to have maliciously taken down “the Fediverse” long ago. There might not be a direct Fedi distinction in the law and it might be too complex for the average district attorney to understand on the surface but that doesn’t equate to “everyone is breaking the law” if something illegal shows up on a feed.

    Saw the bad content get deleted as I was checking it out. The instance looks clean now. Funnily enough, the top post is asking about sudden nsfw content, and one of the comments a gif of someone literally shitting.

    Are you sure it was https://laguna.chat ? I just glanced through the thread that is top of their homepage (Trump’s latest indictment by a grand jury) and the comments were all against Trump. Other posts seem like normal Lemmy stuff, no insane right wingers yelling about space Jews that I could find

      The communities OP was talking about are there, but they don’t seem to have any posts/comments and only have 1-3 subscribers.

      Still, you’d think if an admin actually had their hand on the wheel there, they’d take care of those.

      The homepage opens on the “All”, which shows stuff from outside the instance. Checking the “Local” shows a number of porn posts. Showing only commentaries instead of posts, the current newest one is a “porn” gif of a woman shitting on the floor.

      Browsing from the web, the rest of the commentaries seemed to revolve around a user not being able to see outside communities. On the right, there were the shit communities OP mentioned that should be reported.
